This website is information about a marketing service. Nothing on it is a guarantee of results, and nothing on it is a contract. If we work together, a separate written agreement governs that work and it beats anything said here.

2. What this website is

This site describes marketing services offered by Prozpect Pro, a business based in Bismarck, ND. The content is provided for information. It is not professional, legal, financial or business advice for your particular situation.

3. No guarantee of results

This one matters, so it is stated plainly. Search engine rankings, advertising performance, lead volume and revenue are affected by search engine algorithms, competitor behaviour, seasonality, your pricing, your sales process, your crew capacity, and the weather — most of which neither of us controls. Prozpect Pro does not guarantee any specific ranking, lead count, conversion rate, or revenue outcome, and no statement anywhere on this website should be read as such a guarantee.

Any results described on this site relate to specific clients in specific circumstances. They are not a promise of what will happen for you.

4. The free market audit

The free audit is offered without obligation on either side. Submitting an application does not create a contract and does not obligate Prozpect Pro to provide services. Applications may be declined for any lawful reason, including that another business in your trade and market is already a client. The audit is provided as-is, based on publicly available information, and you may do whatever you like with it — including implement it yourself or hand it to another agency.

5. Services and separate agreements

Any actual engagement is governed by a separate written service agreement signed by both parties. That agreement sets the scope, price, payment schedule, term, cancellation terms, market exclusivity and ownership of deliverables. Where that agreement conflicts with anything on this website, the signed agreement controls.

6. Ownership of what gets built

Subject to full payment under the applicable service agreement, clients own the deliverables produced for them — website, domain, Google Business Profile, advertising account, tracking numbers and content. Prozpect Pro retains ownership of its own underlying methods, templates, processes and tools, and may reuse them for other clients.

7. Intellectual property on this site

The text, design, code, logo and other material on this website belong to Prozpect Pro unless stated otherwise. You may read it, print it and share links to it. You may not copy substantial portions of it for use on another commercial website.

8. Communications consent

When you submit the application form and tick the consent box, you agree that Prozpect Pro may contact you by phone, text message and email about your enquiry. You may withdraw that consent at any time by replying STOP to a text, by asking to be removed by email, or by telling me on the phone.

9. Third-party services and links

This site references and links to third-party platforms including Google. Prozpect Pro does not control those platforms, is not responsible for their content, terms, availability or policy changes, and cannot guarantee continued access to any of them. Google may change its products, policies, pricing or eligibility rules at any time.

10. Disclaimer

This website is provided “as is” and “as available.” To the fullest extent permitted by North Dakota law, Prozpect Pro disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. No warranty is made that the site will be uninterrupted, error-free, or free of harmful components.

11. Limitation of liability

To the fullest extent permitted by law, Prozpect Pro is not liable for any indirect, incidental, special, consequential or punitive damages, or any loss of profits, revenue, data or business opportunity, arising out of your use of this website. Liability arising from services provided under a signed agreement is governed by that agreement.

12. Indemnification

You agree to indemnify and hold harmless Prozpect Pro from claims arising out of your misuse of this website or your violation of these terms or of any law.

13. Governing law

These terms are governed by the laws of the State of North Dakota, without regard to its conflict of law rules. Any dispute arising from this website will be brought in the state or federal courts located in Burleigh County, North Dakota, and both parties consent to that jurisdiction.

14. Changes to these terms

These terms may be updated. The date at the bottom of this page shows when they last were. Continuing to use the site after a change means you accept the revised terms.

15. Severability

If any part of these terms is found unenforceable, the rest remains in force.
